Here is what our attorney wants you to know about dealing with Terra Organics LLC

1. ORDERS: All orders, terms, conditions of sale and prices are subject to confirmation by Terra Organics LLC.
   
2. ALL orders are subject to pro-rate delivery in the event of partial or total crop failure or for any other cause.
   
3. All prices are F.O.B. shipping point.
   
4. PAYMENT: On approved credit - net 30 days. A service charge of 1.5% per month (18% per year) will be charged on all past due accounts.
   
5. MINIMUM ORDER: $100.00 per invoice.
   
6. PACKAGING: Extra Costs for: Large and small poly woven bags, paper bags, plastic pails, foil pouches, cans, boxes, phytosanitary certificates, document fees, expedited shipments, charge for orders under our minimum invoice amount.
   
7. TREATMENT: Additional : Dust $0.15 per pound, Film Coat $1.00 per pound
   

The exclusive remedy for loss or damages due to breech of the foregoing warranty, contract, negligence, or other cause shall be limited to the purchase price of the product and shall not include any consequential damages. Claims for defects in this product must be presented to Terra Organics LLC. as soon as possible to enable Terra Organics LLC. to investigate the claim.

Under the seed laws of several states, arbitration, mediation, or conciliation is required as a prerequisite to maintaining a legal action based upon the failure of seed to which this notice is attached to produce as represented. The consumer shall file a complaint (sworn for AR, FL, IN, MS, SC, TX, WA; signed only CA, ID, ND, SD) along with the required fee (where applicable) with the Commissioner/Director/Secretary of Agriculture, Seed Commissioner, or Chief Agricultural Officer within such time as to permit inspection of the crops or plants by the designated agency and the seedman from whom the seed was purchased. A copy of the complaint shall be sent to the seller by certified or registered mail or as otherwise provided by state statute.
